The short version
- The free snapshot is a one-time look at public listing data. It’s informational, and it comes with no obligation.
- Paid monitoring and enforcement are covered by a separate written agreement.
- We are not a law firm. Formal legal action goes through your own counsel.
- No one can guarantee sellers will stop, and we don’t claim to.
1. Agreement to these terms
These Terms of Use (“Terms”) apply to your use of the MapDelta website and to any free snapshot you request. The website and snapshot are provided by MapDelta (“we”, “us”). By using the website or requesting a snapshot, you agree to these Terms. If you are acting for a company, you confirm you are authorized to accept these Terms on its behalf.
2. Free snapshot
- The snapshot is a set of targeted marketplace observations on a sample of your products, built from publicly available listing data at the time we check.
- It is provided free, for your internal business use, and creates no obligation to buy anything.
- Listings and prices change constantly, so the snapshot may not be complete or current by the time you read it.
- We don’t take any enforcement action, or contact any seller, as part of a snapshot.
- We may decline or limit snapshot requests at our discretion.
3. Paid services
Monitoring, enforcement and reporting services are provided under a separate order form or services agreement signed by you and MapDelta. That agreement sets out scope, pricing, term, cancellation and data handling. If it conflicts with these Terms, the agreement controls. Prices shown on our website are in US dollars, exclude applicable taxes, and may change for new orders.
4. Not a law firm
MapDelta is not a law firm and does not provide legal advice. Nothing on our website, in a snapshot, in a report, or in any policy framework we share is legal advice, and no attorney-client relationship is created. You should review your MAP policy and any enforcement approach with your own legal counsel. Formal legal action is handled by your counsel.
5. Your responsibilities
- You will give us accurate information about your brand, products and MAP policy.
- You are responsible for your MAP policy, including making sure it complies with applicable law.
- You will only ask us to act on products and brands you own or are authorized to represent.
6. Acceptable use
You agree not to misuse the website. For example, you must not:
- Submit false information or request a snapshot for a brand you don’t represent.
- Interfere with the website’s security or operation, or try to access it by automated means beyond ordinary browsing.
- Use the website or any snapshot to harass anyone or for any unlawful purpose.
7. Marketplaces and third parties
Amazon, Walmart, Google Shopping, eBay and other names mentioned on our website are trademarks of their respective owners. MapDelta is not affiliated with, endorsed by or sponsored by any of them. Marketplaces make their own decisions about complaints and reports, and we don’t control their outcomes. Links to third-party websites are provided for convenience, and we are not responsible for their content.
8. Intellectual property
The website, including its text, design and graphics, belongs to MapDelta or its licensors. You may view and print pages for your own internal use. Otherwise, you may not copy, modify or distribute it without our written permission. A snapshot delivered to you may be used freely inside your company.
9. Disclaimers
The website and any snapshot are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not guarantee that any seller will change its advertised price or stop selling your products.
10. Limitation of liability
To the fullest extent permitted by law, MapDelta will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the website or any snapshot. Our total liability for any claim relating to the website or a free snapshot will not exceed one hundred US dollars ($100). Liability for paid services is governed by your services agreement.
11. Indemnity
You agree to indemnify MapDelta against third-party claims arising from information you provide to us that is inaccurate, from your MAP policy, or from your breach of these Terms.
12. Governing law
These Terms are governed by the laws of the jurisdiction in which MapDelta is established, without regard to conflict-of-law rules. Any dispute arising from these Terms or your use of the website will be resolved by the courts of that jurisdiction.
13. Changes
We may update these Terms from time to time. We will change the effective date at the top of this page when we do. Your continued use of the website after an update means you accept the revised Terms.
